La democracia, el derecho y el capitalismo

| Resumen: | El fenómeno de la "nueva extrema derecha" replantea la pregunta por la naturaleza de las instituciones democráticas occidentales: ¿emancipatorias o constitutivamente opresivas? Examinamos el abordaje de Marcio Naves del problema del derecho en el marxismo, que muestra que el derecho es específi camente capitalista y crucial para sus relaciones de producción, por lo cual una política emancipatoria debe realizarse contra el derecho. Por otra parte, examinamos el vínculo histórico entre el establecimiento de la República democrática y la invención de la escuela en Francia: los franceses serán alumnos antes de ser ciudadanos y electores. Este caso ilustra que la relación entre prácticas disciplinarias y formas jurídicas no se reduce al momento de la instauración del sistema, sino que toma la forma de una serie continua de enfrentamientos con una dirección estratégica. Concluimos destacando la necesidad de conocer las condiciones sociales de existencia de las instituciones democráticas occidentales, para lo cual examinamos algunos aspectos del concepto de dictadura de clase. The phenomenon of the "new far right" posits once again the question ;on the nature of occidental democratic systems: are they emancipatory or constitutively oppressive? On the one hand, we examine Márcio Naves' treatment of the problem of law in Marxism, which shows that law is a specifi cally capitalist phenomenon, essential for the reproduction of its relations of production. Consequently, emancipatory politics should be carried out against law. On the other hand, we examine the historical link between the democratic republic and the invention of the school in France: the French will be students before being citizens and voters. This case illustrates that the relationship between disciplinary practices and legal forms is not reduced itself to the moment of the emergence of the system, but that it takes the form of a series of permanent confrontations with a strategic direction. We conclude by stressing the strategic importance of knowing the social conditions of existence of occidental democratic institutions, by examining some aspects of the concept of class dictatorship. |
